These general conditions of sale, which b'oops - Elisabeth Guérin reserves the right to modify at any time, apply and govern all orders placed on the site www.b-oops.ch
1. Price
All prices on the site are given in Swiss francs. Payments must be made in Swiss francs, whatever your reference currency.
2. Orders
Prices are in Swiss francs, value added tax (VAT) included.
The price indicated in the online store at the time of the order is binding.
Additional chargeable services such as delivery appear separately in the basket and on the invoice.
b'oops reserves the right to modify its prices at any time but undertakes to apply the prices in force which will be indicated on the website at the time the customer makes his purchases.
b'oops draws the attention of its customers to the fact that if an incorrect price is displayed (computer bug, etc.), whatever the reason, the order will be canceled , even in case of initial validation. The payment of the price of the products makes the order final. The conclusion of the contract is effective only after the confirmation of the order by the seller. The latter will confirm the order and its payment by sending an e-mail to the address indicated by the customer. The seller reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk. All the information given by the customer is his sole responsibility and any anomalies generated by him cannot be charged to the seller in the event that he is unable to execute the order and carry it out successfully. end.
3. Terms of payment
The customer has the choice between secure payment by credit card (Visa, Mastercard or Amex), as well as by Twint. Card payments are all made online through the secure Stripe platform. The amount of the order is debited immediately upon confirmation. The customer agrees to personally use the bank card he holds. In the event of fraudulent use, the seller cannot be held liable. In the absence of bank provision or in the event of refusal by the banking centres, the order will be automatically canceled and the customer notified by e-mail. For all types of payment, the goods will be sent or delivered to you upon receipt of payment. The products remain the property of the seller until full payment has been received.
4. Delivery and Transportation
Upon receipt of the order on the website and payment, the order will be processed as soon as possible. The available items are sent by post to the address of your choice, in accordance with the elements that the customer has provided to us. The seller declines all responsibility in the event of delay or absence of delivery resulting from the transmission of erroneous or incomplete elements concerning the delivery address that the customer has indicated to us. The time for preparation of the goods and delivery can vary between 3 and 5 working days (from Monday to Friday, day of the order not included) for Switzerland. The shipping costs are CHF 7.-
5. Return or exchange of goods
The customer has a period of 15 days after receipt of his order to return his items if they do not suit him. For the return to be accepted, the goods must be intact, have only been worn for the fitting and returned as received in their original packaging
To return an item, the customer must follow the following procedure:
- Send an e-mail to hello@b-oops.ch indicating the order number, the number of parts and the reason for the return.
- A confirmation email will be sent to the customer with the return address.
Return costs are the responsibility of the customer. Upon receipt of the package, b'oops will exchange or refund the goods. b'oops reserves the right to refuse a return and not to refund the item in the event of damage to the goods or in the event of wear. In the case of an exchange order, the shipping costs of the new order are offered to the customer.
6. Warranty
b'oops only responds to obvious defects noted upon receipt of the product.
Pursuant to Article 201 of the Swiss Code of Obligations, the customer has the obligation to check the condition of the thing received as soon as he can according to the usual course of business. If the customer discovers defects for which B'oops is responsible (visible defects in the product delivered), he must notify it without delay.
In application of article 199 of the Code of Obligations, b'oops is not liable for other damages. It may happen that the design of individual items changes slightly, so b'oops cannot assume any responsibility for such changes from manufacturers and suppliers.
7. Applicable law and competent jurisdiction
Swiss law alone is applicable. An amicable solution must be sought before initiating legal proceedings. In the event of a dispute, the Swiss courts will be competent.
